Bkt Katil MP Shamsul Iskandar, 2 others plead not guilty to assembling at a restricted area

KUALA LUMPUR: Three PKR Youth leaders have claimed trial to participating in a gathering on the day of Blackout 505 rally on June 22.

PKR Youth chief Shamsul Iskandar Mohd Akin, its deputy head Khairul Anuar Ahmad Zainuddin and vice chief Mohd Nazree Mohd Yunus were charged with participating in a gathering at a restricted area, which is a place of worship.

The offence is alleged to have occurred at the compound of Masjid Ar-Rahman in University Malaya on Jalan Pantai Baharu, between 12pm and 1.15pm, on June 22.

Under Section 4(2)(b) of the Peaceful Assembly Act, the three politicians face a maximum RM20,000 fine.

If convicted, Shamsul Iskandar who is Bukit Katil MP could be disqualified from his position.

The three, who faced a summons charge, appeared calm as they stood outside the dock while being read their charges.

Shamsul Iskandar had even tweeted a picture of the trio in court while they were waiting for the proceedings to begin.

DPP Iznina Hanim Hashim suggested a personal bond of RM2,000 with no sureties to be imposed.

Counsel for Shamsul Iskandar, Yusmadi Yusoff urged the court to give a lower bond amount, saying that the nature of the charge was different from those accused of rallying at Padang Merbok, as his clients are alleged to have been in a mosque not at the rally.

“Given the time of the charge – between noon and 1.15pm – it is reasonable to assume my clients were praying. While their innocence is a matter for trial, at this stage to set too high a bond amount would send the wrong message,” submitted Shamsul.

Judge Mat Ghani Abdullah, however, chose to set the bond at RM2,000 with no sureties for each of the three.

He fixed Sept 23 for case management and Dec 11 to 13 to hear the trial.

Khairul Anuar and Mohd Nazree’s lawyer, A. Jeyaseelen told reporters the defence would be filing an application to the High Court to declare the Peaceful Assembly Act inconsistent with the right to assemble as per Article 10 of the Federal Constitution.
